2) illegally charged fees should be refunded

Shiawassee County Committee of the Whole meeting June 20, 2006
Shisawassee County Prosecutor Randy Colbry gave his "report" on the Drain Commissioner.
There were many things brought up that I'm sure most of the news reporters will cover in great detail. One of the things brought up by Prosecutor Colbry was that Drain Commissioner Holzhausen started charging a fee for "waivers", which PA Colbry says he had absolutely no authority to do. Well, this is Shiawassee County. But PA Colbry stated those fees should be repaid.
That's what got my attention! When the county owned up to the fact they had been overcharging for kennel license fees. They lowered the fee to what state law allows.
What the county had been charging was a violation of state law!
Then "to make up for the 'lost' revenue" they adopted a new "policy" of annual inspections with an inspection fee. My kennel fee plus inspection fee, of course, increased my overall expenditure and the county's revenue. Great creative taxation at work here.
But I asked the County Board of Commissioners when they were going to refund the excess license fee they had been illegally charging. Never got an answer.
If they are going to go back and refund those waiver fees, which were charged without authority from the board of commissioners then they might want to seriously consider refunding those excess kennel fees that were charged in violation of state law.
Which is worse: A new official acting without authority of the board or the county violating state law?
I know this has been a bash the drain commissioner fest, but it’s about time somebody took a closer look at the county commissioners and a few others, as well.
