4)kennel license for vet clinics - from Open Forum

NEW: kennel license for vet clinicskaylor <Send E-Mail> -- Thursday, 22 June 2006, at 6:40 p.m.

Well, it was on the agenda for today's meeting of the Shiawassee County Commissioners
This is pretty sorry and yes, I did start a blog on it........
shiacac.blogspot.com
Yes....selective enforcement and much more
The short version
Sheriff Jon Wilson, Prosecutor Randy Colbry and County Coordinator Margaret McAvoy had a meeting tuesday before the Committee of the Whole meeting. They decided what to do about kennel licensing for veterinary clinics.
1. They will amend the county ordinance and take out the word "treatment". That will exclude veterinary clinics from the kennel license requirement.
2. They wrote up a resolution and had Commissioner Roszman make a motion on it today.
3. Colbry stammered and stuttered, he didn't know how that wording got in there (he wrote it) and he thought they had to have a public hearing before they changed an ordinance, publish and public meeting.
So, they are supposed to publish and have a public hearing at the next Committee of the Whole meeting July 25th (?).
They voted down giving the clinics a kennel license as part of their pay for selling dog licenses. They would rather change the ordinance.
I'm not so sure this is even a legal procedure they are about to be doing.
Those three had a little meeting all on their own? They made up the resolution.
I think that meeting could have been subject to the open meetings act.
Too bad they couldn't do anything like that for an ordinary citizen.
Well, the license fees amount to around $160,000 now.
The vets get paid $3 for each one they sell.

3)Letter to Lansing State Journal (150 word limit)

I don't know if this was publsihed or not.
Shiawassee County Committee of the Whole meeting June 20, 2006
Prosecutor Randy Colbry gave his "report" on the Drain Commissioner.
One of the things brought up by Prosecutor Colbry was that Drain Commissioner Holzhausen started charging a fee for "waivers", which Colbry says he had no authority to do. He stated those fees should be repaid.
That's what got my attention! When the county owned up to the fact they had been overcharging for kennel license fees. They lowered the fee to what state law allows.
If they are going to go back and refund those waiver fees, which were charged without authority from the board of commissioners then they might want to seriously consider refunding those excess kennel fees that were charged in violation of state law.
It’s about time somebody took a closer look at the Shiawassee county commissioners and a few others, as well.

2) illegally charged fees should be refunded

....................................hmmmmmmmmm interesting
My letter to the editor on that to our local papers and The Flint Journal

Shiawassee County Committee of the Whole meeting June 20, 2006
Shisawassee County Prosecutor Randy Colbry gave his "report" on the Drain Commissioner.
There were many things brought up that I'm sure most of the news reporters will cover in great detail. One of the things brought up by Prosecutor Colbry was that Drain Commissioner Holzhausen started charging a fee for "waivers", which PA Colbry says he had absolutely no authority to do. Well, this is Shiawassee County. But PA Colbry stated those fees should be repaid.
That's what got my attention! When the county owned up to the fact they had been overcharging for kennel license fees. They lowered the fee to what state law allows.
What the county had been charging was a violation of state law!
Then "to make up for the 'lost' revenue" they adopted a new "policy" of annual inspections with an inspection fee. My kennel fee plus inspection fee, of course, increased my overall expenditure and the county's revenue. Great creative taxation at work here.
But I asked the County Board of Commissioners when they were going to refund the excess license fee they had been illegally charging. Never got an answer.
If they are going to go back and refund those waiver fees, which were charged without authority from the board of commissioners then they might want to seriously consider refunding those excess kennel fees that were charged in violation of state law.
Which is worse: A new official acting without authority of the board or the county violating state law?
I know this has been a bash the drain commissioner fest, but it’s about time somebody took a closer look at the county commissioners and a few others, as well.

1) Shiawassee County adopted ordinance in 2000

This has been a long time coming, but its time has come.
I will attempt to provide as much information as I have available.
If any have questions, feel free to ask via the comments and I will attempt to answer....
My position is that I do not believe our Shiawassee County Animal Control Ordinance is written within the laws of the State of Michigan. It is an illegal ordinance....
No one seems to care much. Surely no one can really do much about it. What is one lonely little dog owner going to do? Or even one lonely little kennel owner?...
We are at the mercy of the arrogant Shiawassee County Board of Commissioners, the dog catcher, the sheriff, the prosecutor and judges. None of which gives a rip. ...
They believe they are right, or that they have the authority to say they are right and the peasants beware....
Well, this one has made a few noises and this one will continue to make noises.
